The Accident

On February 27, 2023, at approximately 6:39 p.m., our client was traveling on Beal Parkway in Fort Walton Beach, Florida, when the at-fault driver attempted a left turn at the intersection of SR-189 (Beal Parkway) and Memorial Parkway, failed to yield the right-of-way, and triggered a multi-vehicle collision.

The Fort Walton Beach Police Department responded to the scene and cited the at-fault driver for failure to yield the right-of-way while making a left turn. All three vehicles involved sustained significant damage, and our client's vehicle was declared a total loss.

 

The Injuries

Immediately after the impact, our client experienced severe cervical pain radiating into the left shoulder, accompanied by persistent headaches. She presented to HCA Florida Fort Walton-Destin Hospital, where CT imaging of the head and cervical spine was performed and she was discharged with prescriptions for Cyclobenzaprine, Hydrocodone/Acetaminophen, Naproxen, and a Lidocaine patch.

Follow-up care at White-Wilson Medical Center confirmed cervicalgia and cervical spinal stenosis with myelopathy, along with neck and thoracic strain and post-traumatic headaches. A July 14, 2023 cervical MRI revealed a C5-6 disc protrusion depressing the spinal cord with bilateral foraminal stenosis. Despite extensive conservative treatment—including physical therapy at Primetime Physical Therapy, pain management with Emerald Coast Pain Physicians, a cervical epidural steroid injection, and bilateral cervical medial branch blocks—our client continued to suffer from radicular pain, weakness, and functional limitations.

Updated imaging in 2025 demonstrated interval worsening with C4 involvement, and her treating spine surgeon at Orthopaedic Associates / North Florida Surgeons recommended a multilevel C4-C6 cervical fusion, with the likelihood of additional adjacent-segment surgery in the future.

The Settlement

Following the firm's time-limited demand supported by comprehensive medical documentation, the at-fault driver's bodily injury carrier, GEICO Casualty Company, tendered its full $100,000.00 policy limits in March 2026.

The firm then pursued our client's underinsured motorist benefits and, on May 20, 2026, secured an additional $100,000.00 policy-limits tender from State Farm Mutual Automobile Insurance Company, bringing the total recovery to $200,000.00 in combined policy limits.
